1. Agreement to Terms

These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and 2Err Travel Services ("we," "us," or "our"), concerning your access to and use of the www.2err.co.za website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the "Site"), and the travel services we provide.

By accessing the Site or booking our services, you agree that you have read, understood, and agree to be bound by all of these Terms of Service. If you do not agree with all of these terms, then you are expressly prohibited from using the Site and our services.

2. Booking and Payments

When you make a booking with 2Err Travel Services, you guarantee that you have the authority to accept and do accept on behalf of your party the terms of these booking conditions.

• Deposits: A non-refundable deposit may be required to secure your booking. The exact amount will be communicated to you at the time of booking.
• Final Payment: The balance of the price of your travel arrangements must be paid by the date specified in your booking confirmation. If the deposit and/or final balance is not paid in time, we reserve the right to cancel your travel arrangements.
• Pricing: All prices are subject to change until the booking is confirmed and paid in full. We reserve the right to amend the price of unsold holidays at any time and correct errors in the prices of confirmed holidays.

3. Cancellations and Refunds

Cancellation by You

If you or any member of your party decides to cancel your confirmed booking, you must notify us in writing. Your notice of cancellation will only take effect when it is received in writing by us at our offices.

Since we incur costs in canceling your arrangements, you will have to pay the cancellation charges as outlined in your specific booking confirmation.

Cancellation by Us

We may occasionally have to make changes or cancel your booking, and we reserve the right to do so at any time. If we have to make a major change or cancel, we will tell you as soon as possible and if there is time to do so before departure, we will offer you the choice of:

• Accepting the changed arrangements.
• Having a refund of all monies paid.
• Accepting an offer of alternative travel arrangements of comparable standard from us, if available.

4. Travel Documents and Insurance

It is your responsibility to ensure that all your travel documents, including passports, visas, and health certificates, are in order and valid for the duration of your trip.

We strongly recommend that you take out comprehensive travel insurance for your holiday, covering medical expenses, personal accident, personal liability, and loss of baggage, as well as cancellation or curtailment of your trip.

5. Health and Safety

You must ensure that you are medically fit to travel and participate in the tour activities. If you have any medical condition or disability which may affect your holiday, you must tell us before you confirm your booking so that we can advise as to the suitability of the chosen arrangements.

6. Limitation of Liability

We will not be responsible or pay you compensation for any injury, illness, death, loss, damage, expense, cost or other claim of any description if it results from:

• The acts and/or omissions of the person affected; or
• The acts and/or omissions of a third party unconnected with the provision of the services contracted for and which were unforeseeable or unavoidable; or
• Unusual or unforeseeable circumstances beyond our control, the consequences of which could not have been avoided even if all due care had been exercised (e.g., acts of God, war, terrorism, civil unrest, natural disasters).

7. Governing Law

These Terms of Service and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of South Africa.
